TIMOTHY PHILLPOTTS, et al. v. GOLD CROWN RESORT MARKETING, INC.

Case No.: 2017-CA-006570-O in the Circuit Court of the Ninth Judicial Circuit in and for Orange County, Florida

  1. What is this lawsuit about?

    1. A group of Gold Crown Members filed a class action lawsuit against Gold Crown Resort Marketing, Inc. (“Gold Crown) after their online membership accounts were disabled by Gold Crown as a result of their refusal to pay an Annual Fee.  The lawsuit alleges that Gold Crown’s attempt to charge and collect an Annual Fee from certain Members was a breach of their Membership Agreements, and that Gold Crown’s efforts to implement this change to its prior business practice was deceptive and unfair. 

      Gold Crown denied all allegations in the lawsuit.  Gold Crown has also recently ceased all of its operations, and filed Articles of Dissolution with the Florida Secretary of State indicating that it is no longer in business.  As such, Gold Crown is no longer offering travel packages or any other services to its Members. 

      However, for those Gold Crown Members who had their online membership accounts disabled while Gold Crown was still in business, the parties recently reached a settlement agreement.

  2. Who represents Me?

    1. The Court appointed lawyers Christopher T. Hill and Steven R. Main from Hill, Rugh, Keller & Main, P.L. to represent the Settlement Class as Class Counsel.  However, you may hire and pay for a lawyer at your own expense if you do not wish to be represented by Class Counsel.

  3. When is the final fairness hearing?

    1. The Court will hold a final fairness hearing on October 4, 2021, at 2:30 p.m. via Zoom Meeting ID: 962 0231 1942, Passcode: 355405, before the Honorable Denise Kim Beamer. At the final fairness hearing, the Court will consider whether the settlement is fair, reasonable, and adequate and, if so, whether it should be granted final approval. The Court will also hear objections to the settlement, if any.  The Court will also decide Class Counsel’s application for an award of attorneys’ fees which, if approved, will be paid by Gold Crown.  The Court may make a decision at the Fairness Hearing to finally approve the settlement, or postpone such a decision and continue the hearing.

  6. How do I change my name?

    1. If you are changing your name due to marriage, divorce or court order, a copy of your marriage license, divorce decree or court order is required. You can submit the documentation via email at: [email protected]. In your email, put ‘Name Change’ in the subject line. In the body of the email, provide the name, NoticeID and address of the original class member on the Notice you received. Also provide the new name and address that you would like on future correspondence as well as a telephone number.

      If you are changing your name due to death, documentation is needed to change the name of the payee if the Class Member has died.  Two documents are required for a name change due to a deceased payee. They are: 1) A Copy of the death certificate, and 2) Documentation providing evidence to show the new person as legal heir/beneficiary. This could be a will, estate documentation, probate, etc. The documentation will be reviewed when received and we may reach out to you with additional questions, if necessary.  You can submit these documents via email at: [email protected].
